CHILD SUPPORT GUIDELINES

CS 415P Children and Income in Excess of Tables

09/94 Revised 08/13/08

UCA 78B-12-206

UCA 78B-12-206.   Income in excess of tables.
“If the combined adjusted gross income exceeds the highest level specified in the table, an appropriate and just child support amount shall be ordered on a case-by-case basis, but the amount ordered may not be less than the highest level specified in the table for the number of children due support.”

If the parent’s combined adjusted gross income exceeds the highest level specified in the table, use the highest amount on the table for the number of children on the case.   If the number of children exceed the number on the guideline table, use the amount for six children based on the parent’s income.  If the both the income and the number of children exceed the amount listed on the guideline table use, the maximum amount listed on the guideline table.  If the custodial parent (CP) is unsatisfied with this approach, s/he can hire a private attorney to pursue a higher award using a more individualized case-specific approach.
